Terms of Service

This is the agreement between your shop and ForgeWorks for the use of FrameForge. We have kept it in plain English on purpose. If something here seems unfair, tell us — we would rather fix the terms than argue about them later.

1. The short version

You pay monthly for software that prices and tracks framing jobs. You can leave whenever you like and take your records with you. We will not lock your data behind a payment. In exchange, do not resell the software, do not use it to spam people, and understand that we cannot promise it will never break.

2. The trial

14 days, no credit card. When it ends, the software switches to read-only: you can still sign in, look at everything, and export all of your data, but you cannot create or change records until you subscribe. We hold your records for you, not over you.

We do not delete anything when a trial ends. If you come back six months later, your work is still here.

3. Plans and payment

  • Starter — $39/month. Up to 75 orders a month, 3 users.
  • Shop — $59/month. Up to 300 orders a month, 8 users.
  • Gallery — $89/month. Unlimited orders, 25 users.

Prices are in US dollars and exclude any sales tax we are required to collect. Billing is monthly in advance through Stripe, and renews automatically until you cancel. There is no contract term and no cancellation fee.

Founding Framer: the first ten shops to subscribe get the Shop plan at $39/month, held at that price for as long as the subscription stays active without interruption. If it lapses, the offer is gone and standard pricing applies.

If we change standard prices we will give you at least 30 days' notice by email, and the new price starts at your next renewal. You can cancel before then.

4. Cancelling and refunds

Cancel any time from the billing page. Your subscription runs to the end of the period you have already paid for, then stops. We do not automatically refund partial months — but if you cancel right after a renewal you did not intend, email us and we will refund it. We would rather do that than keep money from someone who is leaving.

After cancelling, the account returns to read-only. Exports keep working.

5. Your data is yours

You own everything you put into FrameForge: your customers, orders, pricing, and photographs. We claim no ownership of it. We use it only to run the service for you, as described in the Privacy Policy.

You can export your customers, orders, catalog and accounting data as CSV at any time, including during a lapsed trial or after cancelling. To have the account and everything in it permanently deleted, email us; we will do it within 30 days.

6. Corner-sample photographs

When you photograph a supplier's moulding or mat sample, you grant us a non-exclusive licence to show that photograph to other FrameForge shops that carry the same supplier item number, and you keep every other right in it. This is what makes the shared catalog work: you get other shops' photographs on the same basis.

You can switch sharing off in Settings at any time, which stops future contributions and also stops you receiving others'. Photographs already contributed remain in the shared catalog because other shops depend on them — email us if one needs to be withdrawn and we will remove it. Deleting your account withdraws your contributed photographs automatically.

Only photograph samples you are entitled to photograph, and do not upload anything you do not have the right to share.

7. Messaging your customers

FrameForge can text and email your customers about their orders. You are responsible for having their permission, and the software is built to help you keep it: text consent is off until you record that a customer agreed, STOP replies are honoured automatically, and every email carries an unsubscribe link.

You must not use FrameForge to send marketing, promotions, or any message a customer has not agreed to receive. Do not re-enable someone who has opted out. Laws such as the US TCPA carry real penalties, and this is the clause where we tell you plainly that following them is your responsibility, not ours.

8. Your account

Keep your password to yourself and use a real one. Tell us promptly if you think someone else has got into your account. You are responsible for what your staff accounts do. Do not share one login between people — add users instead; that is what the user limits are for.

9. Acceptable use

Do not: resell or sublicence FrameForge; copy it or try to extract its source; attack, probe or overload it; attempt to reach another shop's data; upload malware or anything unlawful; or use it to store data you have no right to hold. We may suspend an account doing any of these, and for anything short of an emergency we will contact you first.

10. Uptime, and what we can honestly promise

We aim for FrameForge to be available whenever your counter is open, and we watch it closely. We do not offer a contractual uptime guarantee or service credits — we are a small company and we will not promise a number we cannot enforce against ourselves. We take daily database backups.

Keep this in mind for your own planning: software goes down. If FrameForge is unreachable, you should still be able to write a ticket by hand for an afternoon.

11. Changes to the software

We improve FrameForge continuously. If we ever need to remove a feature you rely on, we will give you at least 30 days' notice by email, and if that removal makes the product no longer work for you, we will refund your most recent payment.

12. Warranties and liability

FrameForge is provided "as is". We do not warrant that it will be uninterrupted or error-free.

Check your prices. The pricing engine calculates from the figures and rules you configure. If a supplier price file is out of date or a markup is set wrong, the quote will be wrong. Pricing your work correctly is your business decision and your responsibility.

To the fullest extent the law allows, neither party is liable to the other for indirect, incidental or consequential damages, or for lost profits. Our total liability for any claim is limited to the amount you paid us in the 12 months before it arose. Nothing here limits liability for fraud, or for anything else that cannot lawfully be limited. Some jurisdictions do not allow these exclusions, in which case they apply only as far as permitted.

13. Data protection roles

For your shop's own account information we act as controller. For the information you record about your framing customers, you are the controller and we are your processor: we process it only to provide the service, only on your instructions, we keep it confidential, we hold it under the safeguards described in the Privacy Policy, and we return or delete it when you ask. Our sub-processors are listed in that policy, and we will tell you before adding a new one. If you need a signed data processing agreement, email us and we will provide one.

14. Ending the agreement

You may stop using FrameForge at any time. We may end this agreement with 30 days' notice, or immediately if you materially breach section 9. If we end it for any reason other than your breach, we will refund the unused part of what you have paid. Either way you keep export access for at least 30 days.

15. Legal odds and ends

These terms are governed by the laws of the Commonwealth of Pennsylvania, United States, and the courts there have jurisdiction. If any clause is unenforceable, the rest survives. Our not enforcing something once does not waive it. This is the entire agreement between us, replacing anything said earlier. You may not transfer it without our consent; we may transfer it if the business is sold.

If we make a material change, we will email account holders at least 30 days before it takes effect. Continuing to use FrameForge after that means you accept the new terms; if you do not, cancel and we will refund the unused portion.
